The judgement of the Polish Constitutional Tribunal from 7 October 2021 (K 3/21) and the principles of the European legal order – online seminar at the Complutense University in Madrid

On December 16, the Institute of European Law and Regional Integration at the Complutense University in Madrid organized an online seminar on the judgement of the Polish Constitutional Tribunal from 7 October 2021. One of the panellists was Dr. habil. Adam Krzywoń, Research Associate at the FÖV research area “European Administrative Space”, who presented a speech titled “The judgement K 3/21: a question of primacy?”. He argued that the judgement constitutes a typical case of abuse of the constitutional identity and that it resolves a false problem, as in reality there is no conflict between the norms of the Polish Constitution and the EU law as far as the guarantees of the judicial independence are concerned.
