Retrospective: Consultation workshop on the controlled sale of cannabis

Description and content of the event
At the invitation of the Youth Check Centre of Excellence (KomJC), around 20 participants aged between 12 and 27 from almost all of Germany's Federal States met in Berlin from 11 to 13 November 2022 to discuss the proposal for the regulated sale of cannabis as outlined in the coalition agreement. The aim of the workshop was to document the perspectives of young people on the topic and to use these impulses for the creation of a youth check as soon as the corresponding draft law is available.
In-depth discussions on the potential impact of legalisation
The weekend consisted of a mix of plenary debates, exchanges with experts and small group work, where young people were able to discuss the specific effects of legalisation in depth.
The Federal Government's framework paper on the planned controlled sale of cannabis was the starting point for the young people's feedback. However, the paper still leaves some questions unanswered with regard to the design of the law. Consumption in public spaces and its effects on young people comprised a particularly controversial aspect of the consultation workshop.
The results of the consultation workshop were documented in a report. They were also included in the development of a Youth Check for the 'Draft law on the controlled consumption of cannabis and on the amendment of other provisions (Cannabis Act) (as of 16 August 2023)'.

Competence Centre Youth-Check (ComYC)
The youth-check helps to raise awareness of young people’s concerns during the legislative process. It is a regulatory impact assessment tool to analyse the impact of federal legislation on young people aged between 12 and 27 years In order to raise awareness of the concerns of young people at an early stage in the legislative process, the youth-check is applied to proposed legislation during the draft bill stage. The youth-check is carried out by the Competence Centre Youth-Check (ComYC). The ComYC is an independent unit with a unique expertise in youth-specific regulatory impact assessment in Germany. It is the only scientific institution in Germany that carries out an accompanying regulatory impact assessment (ex-ante assessment) for all federal government bills.

Jugend-Check zum Entwurf eines Gesetzes zum kontrollierten Umgang mit Cannabis und zur Änderung weiterer Vorschriften (Cannabisgesetz)(Stand 06.07.2023)
Mit dem Cannabisgesetz (CanG) sollen der private Eigenbesitz sowie der private Eigenanbau von Cannabis zum Eigenkonsum unter strengen Voraussetzungen legalisiert werden. Dafür sollen u.a. das Cannabisanbaugesetz (CanAnbG) und das Medizinal-Cannabisgesetz (MedCanG) neu geschaffen werden.
Aktualisierter Jugend-Check zum Entwurf eines Gesetzes zum kontrollierten Umgang mit Cannabis und zur Änderung weiterer Vorschriften (Cannabisgesetz) (Stand 16.08.2023)
Mit dem Cannabisgesetz (CanG) soll der private Eigenbesitz sowie der private Eigenanbau von Cannabis zum Eigenkonsum unter strengen Voraussetzungen legalisiert werden. Zudem soll mit dem Gesetzvorhaben zu einem verbesserten Gesundheitsschutz beigetragen wer-den. Es soll die cannabisbezogene Aufklärung und Prävention gestärkt, der illegale Markt für Cannabis eingedämmt sowie der Kinder- und Jugendschutz gestärkt werden.
Überblick Bundestag Jugend-Check zum Entwurf eines Gesetzes zum kontrollierten Umgang mit Cannabis und zur Änderung weiterer Vorschriften (Cannabisgesetz) (Kabinettsbefassung: 16.08.2023)
Der „Überblick Bundestag“ wird bei Jugend-Checks erstellt, bei welchen der Gesetzentwurf in der Kabinettsfassung vorliegt. Das bedeutet, dass dieser Gesetzentwurf in der vorliegenden Fassung im Bundestag diskutiert werden wird.
Bericht zum Beteiligungsworkshop zur kontrollierten Abgabe von Cannabis
Das KomJC lud 20 Teilnehmende zwischen 12 und 27 vom 11. bis 13. November 2022 nach Berlin ein, um über die im Koalitionsvertrag beschlossene Idee einer kontrollierten Abgabe von Cannabis zu diskutieren.
