Evaluation of the Administrative Regulation on the Award of Public Contracts (VwV Beschaffung)
The Verwaltungsvorschrift der Landesregierung über die Vergabe öffentlicher Aufträge (“VwV Beschaffung”) governs the paid procurement of goods and services in Baden-Württemberg. The VwV Beschaffung was revised in July 2024. This revised version introduces higher monetary thresholds for certain procedure types and, for the first time, a pilot project for innovation-friendly procurement from start-ups. For both of these provisions, the VwV Beschaffung foresees an evaluation by the end of 2026. In November 2025, the Ministry of Economic Affairs, Labor and Tourism of Baden-Württemberg commissioned the NIPAG to carry out this evaluation.
As part of the evaluation, particular attention will be paid to the participation of start-ups in public procurement and the practical use of the new, higher monetary thresholds. In addition, the bureaucratic burden on awarding authorities, companies and start-ups will be examined, as well as compliance with the budgetary principles of economy and frugality. The analysis follows a retrospective impact assessment and adopts an interdisciplinary approach. The data base will consist of both quantitative and qualitative methods to adequately reflect the perspectives of the relevant stakeholders, especially awarding bodies, companies and start-ups.
Based on the findings, conclusions and practical recommendations will be developed. These will provide the client with realistic design options and support evidence-based decision-making, for example on whether to continue, abolish, or adjust the provisions.
