Evaluation of the Rhineland-Palatinate Police and Regulatory Authorities Act (POG) (Phase 2)

On 26 January 2011, the state parliament of Rhineland-Palatinate passed an amendment to the Police and Regulatory Authorities Act (POG). The aim of the amendment is to create a modern and efficient POG in order to continue to guarantee the safety of the general public. Sec. 100 of the POG contains a new evaluation requirement, according to which the state government must report to the state parliament on the effectiveness of certain measures requiring intensive intervention. The Ministry of the Interior, Sport and Infrastructure of the State of Rhineland-Palatinate once again commissioned the National Institute for Public Administration Germany to carry out the 2nd phase of the evaluation (2015-2016). The final report was published in 2017.

Development of a tool for prospective and accompanying legislative impact assessment

In the Protestant Church in the Rhineland (EKiR), the Synod is responsible for enacting legislation and overseeing the church budget. In recent years, the Synod has initiated a number of reform projects that have resulted in significant changes to the existing framework. In its reforms, it is of paramount importance to the EKiR that the implementation of the planned regulations and measures does not place an undue burden on the congregations. For this reason, the Regional Church Office, which is responsible for the development and elaboration of regulatory projects within the EKiR, needs a tool with which the consequences of regulatory projects can be systematically recorded and assessed. This should make it easier to identify potential implementation problems at an early stage so that they can be taken into account in the legislative process. In order to meet this need, the EKiR has commissioned the National Institute for Public Administration Germany to develop a bespoke tool for prospective and accompanying legislative impact assessments that is specifically tailored to ecclesiastical legislation.

Evaluation of the administrative regulation on public consultation

On behalf of the State Ministry of Baden-Württemberg, the National Institute for Public Administration Germany is evaluating the 'Administrative regulation on public consultation' to regulate non-formal public consultation and the 'Guidance for a new planning culture'. The three-year evaluation comprehensively examines the current procedures of the regional councils in Baden-Württemberg with the help of questionnaires and guided interviews. In addition, all resource requirements (working hours), overheads (such as coordination tasks and training) and other important consultation measures (impact on third parties in accordance with Section 10 of the Federal Emission Control Act (BImSchG), impact in the area of planning approval procedures and regional planning procedures as well as consultation measures undertaken by the approval authorities for third parties) are included.

Evaluation of the Right-Wing Extremism Database Act (RED-G)

In response to the murders by the National Socialist underground, the Right-Wing Extremism Database (RED) was launched in September 2012. The RED-G requires 36 security agencies to store relevant information on violent right-wing extremists in the RED, ensuring that each participating agency has direct access to the data. This is designed to facilitate the exchange of information between the authorities and ensure a more effective response to violent right-wing extremism. Article 3(2) of the Act to Improve the Fight against Right-wing Extremism (Gesetz zur Verbesserung der Bekämpfung des Rechtsextremismus) of 20 August 2012 stipulates that the RED-G is to be evaluated by 31 January 2016 with the involvement of academic experts. The Federal Ministry of the Interior (BMI), in agreement with the German Bundestag, commissioned the National Institute for Public Administration Germany to carry out the evaluation.

Evaluation of anti-terrorism legislation

Article 9 of the Act Amending the Federal Constitutional Protection Act of 7 December 2011 states that the Federal Government shall evaluate the application of the provisions of the Act on the Protection of the Federal Constitution, the MAD Act, the BND Act and the Security Screening Act which were created and amended by the Anti-Terrorism Act, the Supplementary Anti-Terrorism Act and the Act Amending the Anti-Terrorism Act, with the assistance of one or more experts. It is of particular importance to consider the frequency and impact of the restrictions on fundamental rights associated with the powers of intervention, as well as the effectiveness of the relevant provisions. The Federal Ministry of the Interior has commissioned the National Institute for Public Administration Germany in Speyer to undertake the evaluation project.

Development of guidance for the implementation of ex-post evaluations of legislation, with particular attention to the impact on data protection.

In recent years, the quality of legislation has come under increasing criticism. In the context of the better regulation agenda, measures have been introduced to improve the overall quality of legislation. Impact assessment has been identified as a key tool for optimising legislation and is repeatedly mentioned as a core element of such an approach. In addition, questions about the impact of legislation on data protection, especially in the security sector, have recently emerged as a prominent topic in public and political discourse. Against this background, the Federal Commissioner for Data Protection and Freedom of Information (BfDI) commissioned the National Institute for Public Administration Germany to develop guidance for the implementation of ex-post evaluations of legislation, with a particular focus on data protection impact assessments.

Evaluation of the reorganisation of the Federal Police - Federal Police Headquarters

The emergence of new challenges and the aggravation of existing challenges for the Federal Police make it imperative to fulfil the related tasks in the future, taking into account the constraints of the limited public budget. Consequently, the Federal Police have been restructured by the law amending the Federal Police Act of 26 February 2008 in order to increase the operational effectiveness of the Federal Police, in particular its visibility, by streamlining and increasing the efficiency and flexibility of the organisation (see Parliamentary Document 16/6291). In order to achieve these goals, the Federal Police Headquarters in Potsdam has been established as a higher federal authority which controls and is responsible for the work of the entire Federal Police. This reorganisation of the Federal Police is subject to a comprehensive evaluation in order to determine the degree to which the objectives, the desired impact and the economic efficiency have been achieved. In this context, the Federal Ministry of the Interior (BMI) has commissioned the National Institute for Public Administration Germany to evaluate the establishment of the Federal Police Headquarters.

Evaluation of the Federal Act Governing Access to Information held by the Federal Government (Freedom of Information Act - IFG)

The Evaluation of the Federal Act Governing Access to Information held by the Federal Government (so-called Freedom of Information Act - IFG) aims to increase public participation, transparency and openness in public administrations. The IFG entered into force in 2006. The evaluation project examined the achievement of the law's objectives and its impact. The legal analysis included an evaluation of the case law on the Freedom of Information Act (IFG) to date. The focus was on the aspects of scope and protections/exceptions (Sec. 3-6 of the Freedom of Information Act), taking into account comparative international and European legal references. The sociological analysis included quantitative and qualitative surveys.

Evaluation of the Freedom of Information Act of the State of Rhineland-Palatinate (LIFG RP)

The Freedom of Information Act of the State of Rhineland-Palatinate (Landesinformationsfreiheitsgesetz Rheinland-Pfalz - LIFG RP) came into force on 1 February 2009. Section 15 of the LIFG stipulates that the state government, in collaboration with local umbrella organisations, is to evaluate the effects of the law and present a report to the state parliament after a period of three years. The evaluation will examine the objectives pursued by the Act, as well as its organisational, personnel and financial effects.
