Evaluation of counter-terrorism provisions

Since 2001, the German Bundestag has passed a number of laws to extend the competences of the three intelligence services (Bundesamt für Verfassungsschutz, Bundesnachrichtendienst and Militärischer Abschirmdienst) in the field of counter-terrorism. The extension of these competences was supposed to be limited until 2007, but the respective provisions were prolonged and evaluated a number of times (2007, 2011, and 2016).

The Institute of Regulatory Impact Assessment and Evaluation conducted the latest evaluation. It focused on the frequency and the consequences of the encroachment upon fundamental rights that are connected to the extended intervention powers of the three intelligence services. Additionally, these restrictions of basic rights are considered in relation to the effectiveness of the respective provisions.
